Well if you use the DMCA you can have the software removed. The problem is that he can just challenge you to prove your copyright, which may or may not be registered with the Copyright office. You will also need to prove the software source code was created by you if you go to court. Will the cost of a court fight be worth it for a free program? The retainer for a lawyer is about $50,000 for IP cases.
Have you considered Open Source licensing?

The site Main Page - Trunker now appears to give Error 403 - unauthorized access, at least from where I am now.
