No. There are other requirements for programming in the frequencies. You will legaly be able to use the software to program radios as far as Motorola is concerned, but you'll have to follow the requirements for the FCC license for the station that you are programming. If the frequency was licensed through your state/county/city, then you'll have to go through them to get permission.
Each license has a set number of base/mobile radios. If you add radios and go above what the license indicates, then you are not legal and could risk losing the license. I'm sure that whoever coordinated the license would be pretty upset if they lost their license or got fined due to someone programming/adding radios.
