Depends on where you are and WHAT your doing. If your in the commission of a crime scanning is illegal is most if not all states. Scanning is usually permitted even if illegal otherwise if your a ham. Most states allow scanning, some restrict scanning while mobile, Scanning laws are seldom known by officers on the street They assume there communications is legally private.
