Would this thread have even existed...
if the store in question was a local mom and pop store just trying to make a living?
The original OP's friend was being a nuisance and Walmart called the police to have him removed. Simple. I personally find Walmart very convenient. 24 hour, one stop shopping.

Back at home the walmart was using GMRS csq. I think they went to a different system cause too many people were talking on it.

Boy, does this thread bring back memories. The Wal-Mart in town (back when they were *the* Wal-Mart in town) also operated (actually still do) on MURS channel 4 simplex. Well, years ago my fr--well, somebody I'd heard about who apparently lived nearby, "for educational purposes only" (insert disclaimer here) got hold of a MURS walkie-talkie from a yard sale and used to have quite a time pranking them; saying things like "we're in the stooooore! Better come get us, before we call the cops!" from two blocks away! W--erm, they even actually sent Wallyworld into lockdown once, really late at night, for about half an hour or so, and despite their threats to have, uh, these people arrested and kicked off the "property" there was not a thing they could legally do about it!
But, I...don't....know any of these people or anything about them, so......

Huh. Well, from the looks of it, they're now using channel 5 ("green dot") with 94.8Hz PL. So it appears to have changed from what they were using when w--uhh, those people I've, uhh, never met ("for educational purposes only") used to crash them back when MURS was the latest thing.
They've mellowed out, though, the Wal-Mart staff-bots. Hard to get those guys worked up, it seems. They're no fun to talk to any more. ;o)

1. Walmart licensed those freqs. before the transition. IIRC, that means they are grandfathered to use those frequencies in otherwise unlawful manners, in terms of waivers/bandwidth (NFM not required on otherwise NFM only MURS freqs.)
2. It's unlawful to intentionally interfere with others' communications. Same channel use is not illegal, but it's your responsibility to minimize interference to others, despite it being a shared freq.
3. It's private property. They can ask anyone to leave for any or no reason.
4. They work at Walmart, you think they know what MURS is? You think they care? They use pre-programmed Midland/Motorola radios, you think they know how or even have someone to program them?
Go bring in a copy of the FCC regs regarding MURS, I guarantee you they don't know what freq they're on. All they know is that you're talking on 'their' radios.
A bunch of drive-thrus still use MURS freqs, you think you should be able to go around intentionally interfering with them by using the same freq they are?

Well, the "legality" dead horse has been beaten to a pulp enough as it is (including in this thread), so we're not going to engage in yet another debate about it.
That said, whether or not the Wal-Mart staffbots realise it, they are in fact communicating within what is now considered publicly-accessable RF spectrum, thus they should hold no expectation of "privacy" or immunity to interference because of it; whether it be from another company across town with a base station or some dude on a mountain bike at a city park two blocks up the street with a $30 Chinese walkie-talkie. Ignorance being bliss, this Wal-Mart is no different from businesses that insist on using, say, CB or FRS (yes, I am well aware of the difference/s in regulation between FRS and GMRS) for communications. Either the installations that use such spectra are really, really old (the system at this WM does predate the establishment of MURS by several years) or the people who put them in place are just really, really out of touch.
And only the store and the immediate vicinity i.e. the surrounding parcel is Wal-Mart's "private property". The segment of the airwaves they use is not. Likewise, a taxpayer-funded city park that they have no jurisdiction over is not. But, I believe that has been covered in considerable depth in this thread as well.

So someone needs to hire an attorney to contact Wal-Mart, either store-by-store, regional office-by-regional office, or through corporate HQ, and educate them as to what the rules & regs are for using whatever radio service/frequency they happen to use.
