i dont know if its legal or not but while i was scrolling through some you tube videos i came across two plaincloths nypd officers who were questioning two guys on a subway train, after escorting them off the train they told the guys that they were going to check them for warrents and if they had none they were free to go. when the sgt used his radio you can clearly see that this radio is a baofeng radio.
is the nypd resorting to baofengs now?? and if so is it legal?

That is not a issued department radio. Probably using his own radio. There are a few guys out there who do this because of the size of the radio, the radio is not public safety grade or type accepted.

He is using a Baofeng UV-5R which has a Part 90 type acceptance from the FCC. Part 90 type acceptance classifies the radio as 'commercial' and legal for use on business band or public safety frequencies.

I know several fire departments who bought these with small grant money for interop frequency use due to it being cost effective. I'm not saying I agree or disagree. I never used a radio like these before.

My bad. It may be type accepted but I would not call it public safety grade/ mission critical.

I certainly wouldn't recommend it, and they won't take any kind of beating, but it isn't illegal to do so. And I remember some time loooong ago the detectives in Philly would often buy their own portables for the old UHF channels.

maybe they just want to go where no man has gone to listen to them.
when up in the ny/nj area i did hear some ny pd on business repeaters and only referred to each other by rank and that is what gave it away, it involved child care so it was a good plan. and even i did not think that bergen county sheriffs would use a 472 business freq.

It's not authorized by the Dept. To use non issued radios, and can result in discipline for the MOS who uses one.

I used a Wouxun KG-UVD1P at work for a while in a similar environment, and it held up to a massive beating for about three years.. we actually changed our radio system before anything went wrong with the radio. So though they may not exactly be MIL STD, I can at least attest to the ability of these chinese cheapos to function pretty well when made right.

Anyone ever thought the legitimacy of this video? I know the one has a NYPD Sgt badge(or at least looks like it) and both are wearing vests... I don't know though, they should have Vertexes and if they are transit they should have an APX. Just IMHO.

The US Coast Guard at Station NY are using these Baofeng radios as a way to listen to the local precinct, I saw a couple USCG PD wearing the small radio on a chain around their neck in uniform in an office setting.

Look, the Yaesu I had for several years is going on Ebay and I replaced it with two Baofeng radios. These radios are game changers - whether you like them or not.

I do not think the Baofeng radios would actually work for transmitting on NYPD frequencies the way they can potentially work for other departments because the NYPD repeater system (although conventional) is built in such a complex manner, Baofeng radios won't work with the repeater system by simply transmitting on their input frequencies using the proper PL. However, they may work on the NYC Transit PD system.

There is nothing complex about the NYPD's radio configuration with the exception of some odd ball input channel spacings or some split PL's.

My point is that Baofengs cannot trigger their repeater system even if you set them with the proper PL and input frequency. Fyi, there is a thread on here that specifically discusses how the nypd repeater system operates very differently than most other conventional systems.

Actually. Your mixing up the NYPD with the FDNY. The NYPD is using conventional repeaters with voting and microwave backhaul. Nothing crazy, nothing your standard radio if configured properly would be able to access and transmit on. The FDNY is using more of a base/repeater where the dispatcher/control point must enable the repeat function.
