It's complicated, but basically, it will have to be pried from NYC's cold dead hands.

There are no current plans for migrating off T-Band, the NYPD is very happy with the coverage of the current system, and there's a (not entirely unjustified) belief that the city has enough clout to stave off any mandate.

On top of that, the giveback is supposed to be funded by spectrum auctions that haven't actually happened yet.

So while anything could happen in the long term, it will be the long term at the earliest.

It's not the choice of the FCC to decide whether to go through with it or not. It's a Congressional mandate upon the FCC. Congress would need to change the law (which is of course, possible).

T-Band Working Group

Public Law 112-96, Section 6103.
in part quoted "...Not later than 9 years after the date of enactment of this title, the Commission shall – 1.Reallocate the spectrum in the 470–512 MHz band (referred to in this section as the "T-Band spectrum") currently used by public safety eligibles as identified in section 90.303 of title 47, Code of Federal Regulations; ..."

That is the waiver for the FDNY and some other agencies to extend their time to narrowband or migrate off some current frequencies, nothing to do with T band if the D block legislation actually remains as it is now. It was granted. The portion about NYPD narrowbanding became a moot point once it was decided T band frequencies did not have to narrowband.

You are correct, it is Narrow band, but addressed T-Band, which is now a whole other issue

"The main portion of the UHF system used by FDNY and NYPD operates on frequencies in
the “T-Band” (470-512 MHz), for which the January 1, 2013 narrowbanding deadline has
previously been waived in the T-Band Narrowbanding Waiver Order.3 The City now seeks a
similar waiver for additional non-T-Band channels that are operationally integrated with the
T-Band systems.4 "

... that said ... I am fairly certain the City of New York has filed with the FCC to retain their current frequencies. There was an exchange, which I can't find now, that basically said "you want to be the person to shut the NYPD's radios off and get reelected?" ... or something to that effect

I have been told by someone who follows this closely, that there will be a bill filed in the next Congress to repeal the D block law. Since New York City, Los Angeles, large sections of eastern MA, and other large urban areas use UHF-T it is expected to have many co sponsors.

Time will tell.
