Well, my first answer is because they are two different scanner models WS1080 for the Legacy upgrade and WS1095 for the 1095. That said, according to the Whistler Download Website it shows CPU Update versions 4.8 for the 1080 and 4.0 for the 1095.
The Legacy Upgrade on the Whistler website (Boot 2.0) shows version 4.8. If you have a version 4.9 in your scanner, the website has not been updated. Did you just have the upgrade done after Whistler being bought by Goliad?

Na I had it done forever ago when it was like 70 or something. But I was looking at firmware of both and realized one said 3.9 the other said 4.9 so I thought it might been outdated on the desktop one but it told me 3.9 was latest. So I just didn't understand why one is different than other
Because they are two different models of scanners, while the CPU firmware may be identical the version numbers are different due to being different models
