There is no law prohibiting carrying a scanner in NYS, so please don't spread misinformation. If you're referring to mobile use of a scanner (inside a vehicle), that is a separate issue that a sticky thread in this section of the forum addresses.
I'll throw an astricts in there....PL 140.40... "Unlawful possession of radio devices".... don't go knock off a convenience store rocking a scanner with local PD blasting on your hip.

I'll save everyone the click

§ 140.40 Unlawful possession of radio devices. As used in this section, the term “radio device” means any device capable of receiving a wireless voice transmission on any frequency allocated for police use, or any device capable of transmitting and receiving a wireless voice transmission. A person is guilty of unlawful possession of a radio device when he possesses a radio device with the intent to use that device in the commission of robbery, burglary, larceny, gambling or a violation of any provision of article two hundred twenty of the penal law. Unlawful possession of a radio device is a class B misdemeanor.

The Cliff Notes of the law - Don't do a robbery, burglary, larceny, illegal gambling, or sling dope while wearing a scanner.

Everyone else, enjoy your scanners! Common sense right?

My wife & I went to Niagara Falls NY to get married. I brought several radios & SDRs and captured plenty of activity from both sides of the border. I'd strongly advise against bringing it aboard "Maid of the Mist" despite how "water resistant" some here claim it is

If I plan on listening to my radio in public, I like to use headphones that are for music.
Everyone just assumes I am listening to music. Also I keep the radio out of sight.

I go to Niagara Falls Ont. just about every day because my family lives there and have had no problems with scanners, keep the scanner out of site, use headphones, if you go to any of the Casino's do not let anyone see it or hear it or you will be escorted of the premise immediately, that goes for any of the big hotels people do not want you on their premises with the scanner.
