I saw that same article myself, yesterday. Interesting. They might not enforce that because of Native land rights etc..

As long as low power broadcast stays within the confines of their territory?

CKON in Akwesasne Mohawk reserve near Cornwall is not licensed by the FCC or CRTC, and it runs 3000 Watts ERP for years and the studio transmitter is on native land , right on the border of NY and Quebec. It was licensed by the Mohawks themselves.
