I haven't found much that addresses the legality of recording radio traffic and sharing the files with other people.

Legal or not? Your thoughts?

your not suppose to record or transfer any information from police communications, i dont know about other stuff, but I know that Police is for your ears only

The way I interpret the Communications Act; with the exception of broadcasts intended for the general public, Amateur and CB it's illegal to divulge the contents of radio transmissions. By way of explanation the key word is "content" rather like a copyright, you can talk about it but you can't repeat it verbatim. As far as recording goes again there's the "copyright" issue; record all you want for private use, just don't disseminate the files.

I have no official word on internet streaming and I'm not about to ask, I'd rather not open a can of worms with the FCC.

Any kind of recording is illegal under the Electronics Communications Privacy Act of 1986.

My purpose for this thread was to see if I could - legally - upload recordings to a website or FTP directory for later listening, possibly for educational purposes.

Do the same provisions protect unencrypted digital forms of radio traffic generated solely by a computer for remote diagnostics or control? In other words, does it apply only when live person(s) are talking?

I've shared some of my recordings of police and mil-air stuff on here, never though is was a problem and was never told it was a problem. After all it is public information. You can request radio transmission logs from the police and they have to give them to you for a nominal fee of course. I upload recordings to my comcast account and share with all who care to listen on occasion.

We need some lawyer/scanner enthusiasts to join this site and peruse these forums.

My understanding of law in general is that it doesn't matter how you interpret it. It only matters how the relevant enforcement agency interprets the law.

Then all of these people that have LIve streams are illegal??.. How about the LE agencies that even stream it themselves???

I dont make it my hobby if reading the

Law enforcement agencies don't have the final say. That is why we have judges and juries.

From what I would guess it's perfectly legal to record and listen for your own use but as soon as you use it for any other thing that would not be considered 'fair use' its probably not legal...this would be like hooking a scanner up to a PA system and playing it over the whole city or broadcasting it over FM broadcast radio or something rediculous like that....you have to remember though, radio waves are not copyrighted. I do believe they are in public domain. It gets very weird. They are free to use but you cannot use them as if they are public goods.

Poltergeisty; No, we don't.. Anytime you introduce some lawyer in the equation they try to balance it. Thus, kiss this site goodbye.

That's exactly the can of worms I wrote about so let's keep it "don't ask, don't tell" shall we?
