BCD396T: VHF/UHF Rx issues...

Hi All,
I am really torn as to whether or not I should buy the 396. Aside from Digital and analog 800 systems I scan a lot of VHF & UHF. The news I am hearing about this radios inability to effectively receive these bands is of great concern to me.
My question is this: Will these issues be corrected via firmware updates, or are they strictly hardware or non-firmware issues that can only be corrected at the factory?

I have a 396 & just programmed another radio for someone else - and they both receive supremely well on VHF/UHF....you just have to specifically select "FM" as appropriate on the software. Using "AUTO" for any non-AM freq will default to "NFM"...and this may adversely affect performance- it did for me, at first, across VHF/UHF. Minor software glitch. The radio is outstanding.
