Confirmed: DRPS doesnt care about in car scanning

So i have officially confirmed that DRP doesnt care about scanners, although idiot me needs to be more careful next time and not make it so obvious, i know that the laws are fuzzy in ontario, but i have always been paranoid of some cop confiscating my scanners due to mischief....anyways, the funny part of the story was me and my buddy took a run to Henry's (Photo place) to pick up a part for his Camcorder, i had both my 250D and 796D running in the truck and while we were coming back we got stopped by RIDE. Anyways, wasnt paying attention and drove up to the cop and stopped, my buddy has his camcorder out messing around with it and i had two laptops sitting in the back in clear view as well, all of a sudden OPP comes over the radio asking for a plate check JUST as the cop is talking to me. He then asks me, "So whats the scanners for guys"....me, kinda dumbfounded just responded with "Personal Listening Pleasure"...k, have a good day...lol....so anyways, this story doesnt have much of a point to it other then i would like to point out my moronic answer and experience with DRP, lol....i am still hiding my scanners next time

Well, you hit the nail on the head there...they probably won't care if they stop you at a RIDE check. Especially since they're on iDEN and they know you're not listening in.

Personal listening pleasure...that's a good one.

...the last OPP officer who saw my scanner in my vehicle said "Don't let anyone catch you messing with that thing while you're driving. That would be an HTA infraction."

Oh, i know they have nothing to worry about, but i didnt know if they would step up on behalf of OPP, lol

Highway Traffic Act http://www.e-laws.gov.on.ca/DBLaws/Statutes/English/90h08_e.htm
Couldn't find anything about 'scanner' in this loooong web site. Tried other words like 'radio', 'receiver', nothing came up. You shoulda asked him what section of the HTA you would get charged under. If anyone else can think of other words to search for, try them out. Make sure your printer is off, in case you accidentally hit Print.

It would likely be a matter of the officer's discretion. HTA jargon notwithstanding, anything that causes you to fail to have care and control of your vehicle (scanner, cell phone, can of pop rolling under the seat that you are trying to retrieve) could get you jacked up for a ticket, as long as an officer noticed you.

Although it's kind of a lame comparison, the law itself probably says nothing in specific about the use of a hammer as a weapon, yet if I crack you over the head with that hammer, it's assault.

In other words, while it isn't illegal (under the HTA) in Ontario to have a scanner in your vehicle, there are plenty of things that you could do with that scanner (or car stereo or laptop or cell phone) that would be considered HTA infractions. The old line is still applicable: discrete is elite. Any police service could probably care less, but why even put them in the position to ask about your scanners anyway?

there's nothing illegal about having scanners in your car guys. in the u.s., yhings are different but here, it is not illegal unless you are fiddling with it excessively enough for a cop to charge you with careless driving or something else in the HTA.

as a reporter with scanners with me at all times, often at scenes with cops, who know they are there, no one cares..its not illegal

That would actually be assault with a deadly weapon...
