Page 57 and 108-111 of the report clearly states that the Scott EZ-Comm is what caused the communications error (the dead key with shorting of wires) and NOT the Motorola radio. The radio did what the external non-motorola accessory told it to do.

Families of 4 firefighters in 2013 Southwest Inn fire sue Motorola

scrotumola, it appears that the lawsuit is referring to more than just the issues caused by the Scott EZ-Comm systems. The lawsuit seems to repeat several of the complaints that were pointed out in the official report, most notably the "bonks" that hampered fireground comms, not all of which were caused by the EZ-Comm systems. Although most of the articles I've seen seem to indicate that only Motorola was being sued, there were also 5 other business entities named in the suit, presumably one of which is Scott.
