Gil Smith at Carter Lake Again

On October 7, 2006 the Larimer County Sheriffs Office received a call reporting a boating accident that occurred around 5:00 P.M. at Carter Lake in the area of the north boat ramp.

Larimer County Parks Deputies responded to the accident and determined a man driving his jet ski on the lake had run into a boat causing minor damage. The driver of the jet ski was arrested for Boating Under the Influence of Alcohol.

Gil Dwayne Fitzgerald Smith, DOB: 070362, from Longmont, was identified as the driver of the jet ski. Smith resisted arrest and became uncooperative during transportation, kicking and banging his head against the vehicle window. An ambulance was called to transport Smith to Poudre Valley Hospital for observation. Smith was released and transported to the Larimer County Detention Center.

Gil Smith was out on bail for the charge of Child Abuse Resulting in Death. The charge stems from the incident which occurred on July 15, 2006 when Gil Smith was towing his 2 year old son, Shay Smith, on a tube behind his boat in Carter Lake. Shay Smith fell off the tube and disappeared in the water. Despite a long and tedious search, Shays body was not recovered.

Gil Smith was booked on the following charges;

- Boating Under the Influence of Alcohol, a class 2 misdemeanor

- Resisting Arrest, a class 2 misdemeanor

- Careless Boating, a petty offense
