Hearing local cops on RR freq!

While preparing my scanner (Pro 97) for a trip on Amtrak, I loaded in the list of railroad freqs in the 160-161 range. While, monitoring them, I keep picking up the Placer Sheriff on 160.545, which is supposed to be a RR freq! What gives?

Up here in Alaska, the Troopers also use several RR freqs (161.xxx) as repeater inputs/mobile freqs.

Looking at their license there is a special condition and a waiver of the rules. They are:

2/5/99 GENERAL: APPLICANT IS ALREADY LICENSED FOR FREQUENCY 160.545. TRANSPORTATION TECHNOLOGY CENTER APPROVED THE MODIFICATION OF THIS FREQUENCY..JB [D3G]

AUTHORIZED BY WAIVER OF RULE 90.19(D) GRANTED 1/19/93.

Any applicant can ask for a waiver of the rule, and if the coordinator for the railroad allocation concurs it is usually granted. I know that some waivers were granted in Georgia to use business frequeancies. Every time I tried to do that in Florida the railroad coordinator objected and never got it through.

In the case of Placer they just had to prove that there were no public safety frequeancies available that would not cause interference and that the rail coordinator agreed.

This seems to be fairly routine, especially with PD. Last time I checked, the Simi Valley, CA PD were still using a freq in the RR band. I think they're grandfathered in sometimes.

If you look at Simi Valley license under administration you will see note on rules were waived, here is the note:

160.785 AUTHORIZED BY WAIVER OF RULE 90.19(D) GRANTED 1/22/91.

It is mostly up to the railroad coordinator, if they object the FCC usually will not grant a waiver of the rules.
