This may not be the place to do this, I don't know? But I'm trying find out if anyone would have heard an incident which took place on 04/04/05, in the GasLamp district of San Diego. My nephew was shot and killed by police that
nite/morning at around 0130 am. This may be a long shot, and maybe not the right place to go to find out any info but have to try anyway. So if anyone can either give me a better direction to go, or actually have any info on this case please let me know. Trying to find witnesses has been hard, so I thought there might be some info on there airwaves....Thanks

Information about witnesses is never broadcast over the radio, nor would any information you are probably trying to obtain. Your best bet might be to contact the local news media and go that way. People frequenting this board for the most part realize the difficult nature of police and work and are generally pro-cop/firefighter. So this is probably not the avenue you want to look down.

I understand, what your saying, and appriciate your advice. I'm just trying to find some who would have listened to the police band that nite and what was said. I do understand the pro cop attitude, but understand this I don't want to become anti-cop, I /we just want the truth. So if you can't ask a group that are pro-cop for honest information, where does that leave you?? I don't want skewed information, I don't want just what I think to be the truth, I want the truth. So if I have to go elsewhere so be it, but I don't fear the truth. By the way the the local media are the worst people to go to, as their views are only what others wish them to be. We've already expierenced that
senario...

More likely than not any radio traffic broadcast around that incident would have consisted of calls for "cover", calls for the supervisor (after the OIS) and info about direction of travel (of suspect if in fact he/she were fleeing/eluding). Information about where people were at the time, who fired, when and where, witnesses and the like are done face to face or via cellphone to the supervisors and investigators. Even if you did find someone who recalled hearing anything about the incident over the police radios, its nothing but heresay anyway, unless a recording was made. Good luck in your endeavor for the truth.

Most of what you've posted that I would get with such a witness is precisely what I'm looking for, hearsay or not. Whether admissable or not that kind of info can still backup, dispute or drive an investigation into a new direction. I'm not one to overlook any possibilities, or angles to get to the truth. We just have many discrepancies with what's been said, so we have to persue. Thanks for the luck as I know we'll need it.

Depending on the status of the investigation/situation, and the circumstances, your only bet is probably going to be either the District Attorney's office, the LE agency involved in the situation, or any civilian oversight boards that may exist as watchdogs for the agency in question.

Any information obtained here (if any) is going to be sketchy. People usually remember generalities, but it's highly unlikely anyone here heard the detailed information you're looking for. It's unlikely that info was ever broadcast, but even if it was, no one has much reason to retain the info. You might, however, get a generalized account of the situation based on radio traffic. Keep in mind, however, that if the agency uses MDC/Ts (in-car computers), a lot of information will not get broadcast, but instead be sent across those.

As far as a civilian conducting an investigation like this, I dunno what to tell you. You might find info to pass on to the agency, but I'm guessing you're questioning the agency's response, ie. killing your family member. Don't know what to say to that.

FYI-All of the officer involved shootings I've heard usually only indicate the number of officers that fired shots, and very rarely will those officers identify themselves by name on the radio (usually saying they need to be relieved because they've fired rounds). Maybe later in the day someone will see this and have info.

If you believe there was officer misconduct involved, get an attorney. As has already been pointed out, the radio traffic probably won't give you any insight into what happened immediately before the shooting, which is presumably the information you're looking for. An attorney can help you by filing for discovery of all materials related to the case including tapes of radio calls, transcripts of MDC data, and official reports filed involving the incident.

My sympathy for your nephew's death. I hope you can resolve this to your satisfaction.
