Until they encrypt the frequencies, there isn't much they can do, its open public airways, unless you interfering law enforcement actions. Scanners are considered legal unless used for illegal purposes, as far as our state goes or thats how I understand it.

I know I am a rookie here. But I have to agree with Phil (scanlist) If the polyester ninjas are down your street doing their thing and you can listen from home. Go for it have fun. How ever if they are a 5 minute bike ride away..best just let them do their thing and watch it on the news. Its not uncommon to have someone watching the crowd at these things, and if your seen time after time after time. You might have to answer some very pointed questions. Just a rookies eye view though.
