Is it legal to own a motorola apx 7000 in the state of Texas?

Legal to own? That one's simple. Sure it's legal to own one in Texas.

Legal to use? That one's not quite so simple. If you're a licensed ham and using it on ham frequencies than sure you can own and use the radio all you wish (following ham rules, of course). If you have a license for Part-90 (business band or public safety operation) and have it programmed per your license than again there should be no issues using the radio.

If you work for a company that has a Part-90 license and you want to program your personal radio and use it under their license, you may or may not have issues. The key phrase is "their license". You'll need their permission (for your protection get this in writing and from someone that's authorized to grant this permission) and follow their rules on how (and where) you can use your radio on their license. You may also need to have their people program the radio to have it done correctly according to their license restrictions and company policies. Just doing it on your own may cost you your job or worse.

If you just want that cool Motorola radio to work as a scanner, basically don't do it, it'll be much more trouble than it's worth. Can one be programmed for receive only use? Yes, but it's not simple, not "follow these instructions and you'll be fine", and definitely not "any radio shop will program it for you". Make a single error programming it and chances are very good you'll be illegally transmitting and in violation of FCC rules and perhaps even local, state, or federal laws. If it transmits (even a little), the system will probably notice and they could send a kill code to your radio and turn that nice expensive "cool scanner" into a nice expensive inoperative paperweight.

You nailed it to the point n5ims and to add to it. It could also include a system key for a system. That usually can only be obtained by a system adminster. I would just by a scanner also. You then cant listen to a system you want. And the radio will go into inhabit mode.

There is absolutely nothing illegal about it. In fact it would be an excellent radio if you can afford it. If you are just looking for conventional vhf and uhf capabilities, there is no more risk of doing anything illegal than if you bought a $50 Chinese radio. Even if you are looking to monitor a trunked system, it can be done easily by scanning the outputs and filtering the talk groups you wish to monitor. Not optimal, but it does work.
If you have the money and time then yes, the APX is perfectly fine. Just take your time searching for the right one from the right seller so you don't get a dud or worse.

System keys ONLY reside on a computer, or a USB dongle. They are only used during programming to allow you to make changes to the trunking parameters with in the CPS.

What will your radio get 'inhabited' with? Ghosts? Goblins? Urchins?

It is extremely rare to find an APX on eBay that is NOT a fake or worse, one that has been abused with what is called 'Accelerated Life Test' protocols. These radios have made it out of the factory test environment through dumpster diving and should NEVER be used, for anything. You would be buying a pig in a poke.

Find a reputable seller, preferably a two-way MOTOROLA dealer, and buy a used certified radio from them, you will end up paying about the same price, but will end up with a radio that has GOOD resale value and will actually WORK, and you can send it to the factory if you ever need to.
