NY Scanner Laws?

Hello all,

I will be traveling through the great state of New York next week and was hoping to do some scanning along my way, however, I came across a webiste (http://www.afn.org/~afn09444/scanlaws/scanner5.html) and I am now throughly confused about scanning laws in NY. From what I can gather, it is alright to use a scanner while stationary but a no-no when in a vehicle without a licence. Is this correct? Please clairify.

Disclaimer: I am not a Lawer . . . . . .

Sounds an awfull lot like if you don't "reside" in NY, then you don't have a problem. ( Of course if you do reside in a place that requires permits, but outside NY, then all bets are off.)

But that is just one 'layman's" reading.

Mobile scanning in NYS is prohibited, period. This includes the use of a portable scanner in the car. The provision for amateur radio operators is pretty specific about what you can receive.

I have known a couple of people who have had scanners confiscated and summonses issued. The spirit of the law is to prevent the use of the scanner during the commission of a crime, which is specified in the NYS Penal Law, as well as the NYC Administrative Code.

I hope this clear it up a little for you.
