I have had my scanner confiscated in Chelsea by the transit LT. they gave me a DAT for unlawful possession, Of what i am not sure. I also remember when someone else here was stopped in the 90th for the same thing and ticketed. I went to Manhattan court downtown and they threw it out, But i never fought to get my scanner back, because 1, it was that cheap little 100 channel racing uniden, and 2, the NYPD will just stop you again and the same process will happen. You can argue all day long with the NYPD about the letter of the law but they do not care. They will issue the DAT with the quickness to keep with the quota. I know this as a fact because this is what i have been told about other DAT summons i received (Possession of a knife, hopping a turnstyle) and they really don't care either way because they have to issue that DAT and transport you to the house for processing and kick you loose.

You would think cops have better things to do in NYC, I would be so butthurt to have a anything taken away from me personally. Did you have an attorney?

I think this more of NYC thing then any other place in the state. I don't understand why it's illegal to stay parked on one channel, and yea listening to a ps scanner out loud is stupid but should it warrant a confiscation and a desk appearance ticket, just really doesn't make sense. I think a ham here got pulled over by the cops in the city and they were flipping channels on his yaesu radio.

On paper, it's not just NYC.

The City of Rochester has an ordinance that prohibits possession of a mobile or portable police or fire receiver. It isn't enforced except possibly in connection with other charges.

Why would it be illegal to monitor one frequency continuously. What could they have possible been thinking when passing such a law?

But if you want to listen to just one frequency and you want to get around that law all you have to do is program a bank with two frequencies in it. One of them being the one you want to listen to and the other being one that you know will have no activity and just let it scan away. All you will hear will be that one frequency and you get all transmissions without interruption.

I wish i had time for social media! I haven't gotten to even get out in weeks with my APX. I need to file for a weekend of PTO and get out there and hike and take the APX with me.

I agree. The law is unnecessary & useless....but, it's the law and you knew it, just like the turnstile and knife thing. That begs the question: Why did you do it?

I always carry a box cutter for work, and i don’t know about you, but I’ve been riding the 3 train for 25 years and refuse to be robbed or assaulted and jumping the turn style, sometimes times are tough and metro cards cost money, in order to get to work I need to get on the train, so you gotta do what you gotta do to pay bills here and get by.

I'm confused, you can remember your knife, but not your metro card? Can't you just leave the knife at work and put more work into remembering the metro card? Two problems solved and you stay on the right side of the law.

Screw the law! Sometimes it is wrong and needs to be challenged!

The first sentence makes no sense. Laws are necessary for an orderly society. The second sentence is right on. Work to educate others and change the law.

Firstly. These charges were years and years ago and they were citations that were paid. I was 17 when I jumped the turnstile In 1998. And it’s not illegal to carry a knife at all. The charges were dropped as the DA refused to prosecute the charge as there is no merit to it.

I’m definitely not looking for sympathy of any type. I had to get to work the summer of 98 and jumped a turnstile and got a DAT. I explained to the judge and she laughed and told me to go home. With the box cutter, the judge laid into the cop and said for him to research the law instead of tying up the courts with frivolous arrest to boost their quota. And that was direct from the manhattan court judge. I don’t sweat it. Everyone has their own opinion of how people should live, but this is NYC. You have to live here to understand it. Everything is backwards

I am talking about laws that make no sense. I am not talking about murder, robbery, rape, etc.

That's how you do it. The law probably made sense and had a purpose when it was enacted. Times change, morals and mores change but the laws are often reluctant to keep up.
