Does anyone know a Nick Buchanan, goes by Nick Fury in Facebook? Says he's located in San Antonio, sold me on an XTS 2500 VHF with programming for $220. I have not heard from him in 6 days and he got paid 11 days ago. When I text and told him that I had contacted law enforcement, after multiple requests for a refund he blocked me on Facebook, and deleted his listing.

He claims to be an active first responder and does upfit installs and designs public safety patches and crap.

If you happen to know this piece of garbage, let him know that I'm about to have him arrested on federal Internet crime charges by the FBI.

Thanks

Tim

Blocked me on that one too. I have other facebook profiles too. I'm going to just start reaching out to his family, friends, listed employers and former employers.... The police refuse to even take a report, saying I need to mail him a certified refund request, most absurd thing I've ever been told in a situation like this. I'll just pester people on his friends list when I have time on the weekends, until he refunds me the money or sends me the radio.

Not sure, but that may be a civil matter rather than a law enforcement issue. Small claims court?

FBI probably won't get involved since your both in Texas. Maybe try the Post Office Police if you mailed him a check. If a card was used call your card company and they can yank your money back!

1) The FBI is not going to get involved in your one radio case. The duty AUSA would laugh at that one.

2) Sending unsolicited emails to friends and family could get YOU a nice visit to the courthouse for harassment depending on what State the person on the receiving end in is.

3) There is a reason why the police won't take a report. Follow their direction. Small claims court is your friend.

I'd send the certified refund request and do make sure it's via certified mail. Then if no response in a week or so AFTER the seller receives it go to your bank or credit card company and initiate a charge back stating you had done as the police told you to but the seller refused a refund. You now have legal ammo to go on.

Better yet, if there is no response from the seller after you send the refund request, THEN try to file a police report which will be the vehicle you'd use with the credit card or bank.

If you want to spend the money an attorney could be an option if the bank or credit card doesn't help. If you're lucky and an attorney is willing to offer pro bono service it'll be for free. They don't have to but are encouraged to offer so many community service hours.

Lesson learned, man. Facebook is a hot mess and that's one reason why I stay far and away from any social media. About 5 months ago I even deleted my YouStupid (YouTube) account.

I'd rather conduct a trade on a site like eBay that has protections built in. So much so it seems like eBay throws the seller under the bus these days.

If you deal with Craigslist et al and deal with cash, buy a counterfeit testing pen at an office supply store. 98% of the time it should work. I keep one in the glove box of my car for this reason. And I conduct the trade where there is a camera. Any low balling, BS, etc from the buyer or BS from the seller and I'm out of there. And stay far away from Crypto unless you know what you're doing...

P.S.

Do not put yourself in a position that makes YOU the wrong doer. The goal is to win the battle. Not freaking lose it.

Prayerfully you used Paypal goods and services. You would have recourse.
I had a chance to get a 346xt at a no brainer price on marketplace and seller agreed to ship. (been successful in charming sellers into shipping) Came down to the end and wouldn't take Paypal. No Paypal, no joy and adios.
I restore old hand tools for a hobby also and Facebook transactions so far have gone OK. Not as much scumbaggery in the tool world I guess.

Unless I missed it, what payment method did you use?

If you look at his Facebook page you see him in a Police Uniform standing with others. It may have been him you were talking to on the Phone when you called Local Law.
If he is police, or worse, impersonating police, this as well as the theft, should be of great interest to some level of law enforcement. by the way Google pictures may help ID that group in the photo.

I won't post it here but going through and looking at one of the pictures on his profile, it shows him with two others in the same uniform, one of them has several large medals draped down their uniform like they were a highly decorated general that served in both world wars...

Yeah I hope the OP gets his money back and gets this guy whipped. Facebook is chock full of scammers. The worst ones are the ones that keep on playing the game. I was inquiring about some Havis gear on FB and right out of the blue some guy says "I will sell you mine". I ask for pictures and name of his company (It was an upfitters page) and he dodges the question asking me 50 more. It is way too easy to get scammed on FB. Especially with Venmo and the like. You have no idea where your money is going. I got burned $20 on some X9000 buttons. The guy did not send what we agreed to and yet he is still out there making details dishonestly. Not a big deal, $20, but really pisses me off when folks blatantly lie to make a buck, waste your time and lie some more.
