SYCAMORE, IL – Two DeKalb brothers were indicted Monday on felony and misdemeanor eavesdropping charges for reportedly recording police officers on a November traffic stop.

DeKalb police said Fanon Parteet, 23, of the 1300 block of West Lincoln Highway, and Adrian Parteet, 20, of the 700 block of Lucinda Avenue, were passengers in a car that was stopped at McDonald’s, 545 E. Lincoln Highway, on Nov. 24. Police had stopped the car on suspicion that the driver had been drinking.

While a DeKalb police officer was talking to the driver of the car, a second officer advised him that Fanon Parteet appeared to be recording him using a camera-equipped cell phone. When asked, Fanon Parteet said he was only recording people inside the car, police said. But when he played back the video, the arresting officer said he saw and heard himself on the recording.

***In Illinois, it is illegal to make a recording of an oral conversation without the consent of all parties. There are exceptions, including uniformed police officers using recording devices like squad car-mounted cameras in the course of their duties.***

While Fanon Parteet was being arrested on the eavesdropping charge and placed in a squad car, Adrian Parteet was using another camera-equipped cell phone to record the arrest, according to police.

At the time, the second police officer on the scene was standing near Adrian Parteet’s window talking to him, and when he asked if he was being recorded, was told Adrian Parteet was only taking still photos. On playback, the officer’s voice is audible as he talks to Adrian Parteet, police said.

After Monday’s hearing, Circuit Judge Robbin Stuckert found probable cause to charge each of the brothers with Class 4 felony eavesdropping, punishable by up to three years in prison, and Class A misdemeanor eavesdropping, punishable by less than one year in jail

In a case in winnebago county 4 years ago,an officer was recorded on a dvr making sexual comments to a female he stopped. He was not aware of the recording. a copy of the recording was delivered to his watch captain warning the distribution of others if the officer is not fired.
The officer resigned quietly as did the repercussions!

That is unbelievable able...
Well i guess the idiots should not have been fumbling with cell phones either; officers sometimes get nervous enough during a traffic stop.

Just hit record, and then place it in your pocket.

The traffic stop occurred on a public street, didn't it? So anything in plain view from the public property is legal.

Either way, I wouldn't have let them see the video I shot. I'd tell them they'll have to get a warrant for that, as it's not a criminal activity nor directly related to one. They have to have reasonable suspicion.

What exactly are these "OFFICERS" trying to hide? They must have felt that the recording would show them in a bad light. Probably due to VIDEOs of officers doing BAD things showing up everywhere. Odd how the government wants to video everything we do (Traffic, downtown, in buildings) but don't want themselves videotaped. What's next spitting on a sidewalk turning into a FELONY. Are the prisons not FULL enough? OH wait ILLINOIS was trying to sell one to the FED's weren't they?

Cops

I saw one on You Tube of a kid getting pulled over in a car park at night. He had a camera recorder going in the car. The cop was heard threatening to send the kid to jail for any charge the cop wanted to make up. The cop got canned. Maybe this is why they don't want people filming them?

Whacha gonna do? Here we got "former officers" being observed by "Current officers" pulling people over on a major roadway. Wonder why he didn't intervene if he knew it was a "FORMER" officer?

Just food for thought here,but now in cities all over the u.s. there are the pole mounted webcams which are intended to curb street crime and now they can curb "cop crime"!
