Since we have been on the legal issues the past few days here is another issue that comes to mind. I have now put up a 110 foot Rohn 25G tower in my backyard. In my county you must get a tower permit for the installation in some cases if you are commercial or not a ham. I would like to post a link to the local code on tower installations in my county and get your opinions. Pay special attention to sec 7-203, since I use my installation for off air TV reception it appears I am excluded from all the code. I am also a ham so that plays a role too if you read along there. Also I would like a good definition of MMDS service. Some of the local 900Mhz WISP's are claiming they are a MMDS service to avoid the code rules.

Looks promising

From what I read, you're right, if you put a TV antenna on top your covered. But there are a couple caviats that I would be concerned with. The first being what the FCC says about off air reception antenna heights, the second with it being 110 foot is the FAA. If there is an airport close, or any possibility of low flying aircraft, then you need to be concerned with that. Beyond that, it seems that your next biggest concern is the neighbors. For some reason, people start *****ing about antenna towers even before they are fully erected. I personally have had people come up and complain about TVI that they claimed was caused by the tower radiating a signal. Mind you there were 4 more sections to go on. There were no antennas on the tower, but still the person persisted. At that point I gave them the number to the Michigan FCC field office and my name and call. I never heard from the FCC about it.

Point is this, *****y people with nothing better to do get listened to. We have farmers out here where I am at that get complaints about smells due to their animals, and the complaints are launched by people that moved in next to an operating farm. It's to the point that when a house of tract of land goes up for sale the local farmers have big signs they place in the fields facing the land or house that's for sale with this on it. "To All concerned, you are in an agricultural area. You WILL be exposed to loud noise, offensive smells, slow moving farm vehicles on the local roadways. Consider yourself warned." A farmers lawyer told them to put up these signs after being sued for creating a 'unreasonable enviroment' due to the smell from his spreading of cow manure.
He won the suite, but so did his lawyer to the tune of several thousand dollars.
There have been farms shut down by crap like this. Someone with deep pockets and an axe to grind WILL cause you tons of grief.
