What is the legallity for owning a commercial 2-way radio in NJ. Say it was purchased at a hamfest or on Ebay is this illegal for a person to have in possession in this state?? Any feedback would be helpful!!

It's not a problem, you can own most any radio you want but transmitting with it is where the line is drawn.

You may only leagally transmit on the frequencies you or the entity you work for are licensed to use.
There are frequencies (like FRS) that do not require a license per say.

It's a deep subject that can be answered with a visit to the FCC website.

I own radios which I use at my place of work but the business has the frequencies licensed, no problem legally as long as I do not use them outside the licensed area of my employer so as not to cause interference witrh other licensed stations.

If you want to monitor a TRUNKING SYSTEM and have one programed into your radio that can be a problem. You need the "System Key" for that agency and they are the only ones that have it. IE. NJ State PD, and so on. If it is a conventional system and you have it set up to receive only then shere should not be any problem, just a really expensive scanner.
