Scanner in your vehicle in NY state

Fellow scanners. I have 1 quick question. I know that for the most part with certain exceptions it is illegal to have a scanner in your vehicle in NY state. My question is, if you are a volunteer firefighter are you then allowed to have a scanner in your vehicle. Just wondering.

Quick answer.. No. VTL397 exempts peace officers acting pursuant to their special duties... Most volunteer firefighters are not sworn peace officers. Most Fire Police members are sworn peace officers, and may be able to squeeze by the law, but there are many examples of this and the ham exemption not holding up.

This has been beaten to death on this forum, do a quick search of past threads for more info. And as always, an excellent resource is nf2g.com where Dave has published an article regarding NYS's approach to scanner laws. Check it out its worth the $5. Don't forget to search the NYS laws which are published online at the NYS Assembly site. Look under NYS Vehicle and Traffic Law section 397 (VTL397).

Thank you fellow scanner for your quick response to my question. It's just a shame that the State of New York has to be such *******s excuse my french about things like this. I see nothing wrong with a volunteer firefighter having a scanner in their vehichle since they are out there protecting the public from harm. It seems like New York needs to really rethink their laws regarding scanners in vehicles and leave the ham operators and especially the volunteer firefighters many of who have lost their lives protecting the public alone.

Just my 2 cents.

By the letter of the law NO you can not BUT, If your a FF and you need your scanner for duty YES you can. If you have a membership card or some kind of id to show that your a FF they most likly will let you go ;) But if your doing something your not suppose to be doing and you get pulled over and they find a scanner in you car they will bust you chops over the scanner too. BUT BY THE LETTER OF THE LAW NOBODY IS ALLOWED TO HAVE A SCANNER IN THIER CAR **WITH PD FREQS IN IT, IN NY WITH LIMITED EXCEPTION :)

You can scan fire and ems in your car.

Yes fellow scanner that helps out alot. I can see if one were monitoring police frequencies in there vehicle. If you are a volunteer firefighter then all you should be concerned about monitoring is fire and maybe ems frequencies, never police frequencies there is no need for that.

There is only one way and that is the way it is written in the VTL section PERIOD . Please READ the VTL and speak with an attorney if you can't understand what the section means. No this is not a double post, this is the first time that I have asked this question. I just got done having a problem with another member on here, Please dont make me have a problem with you to. I was simply asking a question thats all. I'am sure that this sort of thing has been brought up about having a scanner in a vehicle before, however I did some searching and I saw no post where it said anything about having a scanner in your vehicle while you are a volunteer firefighter. I just hate people who can just let someone post a question on here. There always has to be atleast one person among the group that will always say, that question has already been asked please do a search before asking that question. To be honest I'am sure that most every question out here has already been asked in some form or another, so why do we even have the chat boards, if all that people have to do is simply look under the search forum to get their question answered pretty much all of the time then you tell me why we still have the chat boards.

P.S. As I said before none of this would even be an issue if we did not have *******S for law makers in New York State.

Chow, no hard feelings.

Fellow scanners. Thank you to the members who provided me with good solid information regarding my question. You did not judge me for asking my question you simply answered it. However I feel that this post will become out of control so I have asked loumaag to close it down for me.

Just a friendly word of advice. Before you post a new topic, use the search function to see if it's been previously discussed. You can also look up the rules regarding posting previously discussed and beaten with a dead horse topics. I'm not in any way trying to give you a hard time, but many of use just get annoyed reading the same posts over and over again.
