I haven't scanned that 3840 much but from what I catch I haven't heard W6WBJ "live" in a while-I only hear what is another ham playing a recording of him on 3908 jamming up the WARFA net.

I forgot about Part 97, Sec. 97.21 (a) (3) (ii)!!

In reciting the various statutes and regulations which provide for the day-to-day renewal of an amateur license when the renewal application is timely filed but not routinely granted, I forgot to mention that the same provision is contained in Part 97 itself: Sec. 97.21 (a) (3) (ii). I remembered this only after reading a post by N5IMS on this forum. Thank you, N5IMS. You seem like a smart guy, and I'll bet we could have interesting discussions of amateur radio legal issues.

In the case of an amateur license, although the nominal term of the contract is 10 years, it contains [by virtue of the APA, Sec. 307(c) of the Act and Sec. 1.62 of the Rules, as stated above] automatic renewal language providing that if the licensee files a timely application for renewal but it is not promptly acted upon, the license renews on a day-to-day basis until such time as the Commission finally rules on the renewal application and all appeals have been exhausted. Therefore my license has not expired and is perfectly valid.
Yours is not the only case I am aware of. I know another amateur radio licensee who filed for renewal in 2010 and was only granted that renewal last year. In the intervening time, he was allowed to continue operating.
