but how will it be interpreted & enforced?
To me it seems that if its mounted in a cellphone holder to the dash it should be fine , especially since you dont actually talk on it , just wondering for anyone in law enforcement ,..if you see someone with a handheld radio mounted to thier dash ,.....is that enough to pull them over & investigate?
an interesting exception reads..."The use of hand-held radios by amateur radio operators (who provide assistance, especially in emergency situations such as severe storms and blackouts) is permitted until January 1, 2013 to allow hands-free technologies to be developed. "

There is a three-year phase-out period until January 1, 2013 for the commercial use of two-way radios, including mobile and CB radios to allow for hands-free technologies to be developed.
The new law does not affect mobile data terminals, logistical tracking devices and dispatching devices. They are permitted for commercial and public service vehicle drivers who are engaged in the performance of their duties.
Hand-mikes (push-to-talk systems) and portable radios ("walkie-talkies") may be used in a hands-free mode. The driver may use a lapel button or other hands-free application as long as the hand-mike or walkie-talkie is not held while driving.
So some exceptions .....I dunno it seems to me the last people I want driving & using a electronic device are those with a heavy truck at highway speeds ....not to worry though cause they cant smoke in thier trucks now ....while the rest of us still can.....at least I can still eat my breakfast & read the paper while driving though.....probably just until handsfree technology is developed....some can smoke some cant ,some can use radios ,..some cant...none of it makes any sense to me ..
