According to the FCC rules:
§95.631 Emission types.
(j) A MURS transmitter must transmit only emission types A1D, A2B, A2D, A3E, F2B, F1D, F2D, F3E, G3E. Emission types A3E, F3E and G3E include selective calling or tone-operated squelch tones to establish or continue voice communications. MURS transmitters are prohibited from transmitting in the continuous carrier mode.
If you were to follow the letter of the law, no, it's not legal.
Other issue would be type acceptance. To be legal by the letter of the law, your radio would be required to have Part 95 certification, or be built before the cutoff date, which was before DMR was commercially available.
Technically, your radio would likely work just fine on MURS, if you chose to ignore the FCC rules.
