Well the FCC took the first step in issuing the NOUO to him. He has to respond to the NOUO. If there is no response, they follow up with a stronger letter, and possibly a Notice of Violation (NOV). However, if a second interference complaint comes in, the FCC will almost definitely issue the NOV, and often times the Notice of Liability (NAL, a.k.a. a fine). The NAL is handled by the Treasury (collected by the Government's collection agency, the IRS). They WILL collect the money. Either by garnishing wages or what not. But failure to pay is the same as failure to pay taxes, and they will come after for them for the violation, that can lead to jail time. At the stage of the NOV being issued , the US Marshalls could be called in to seize the equipment. Of course, we've all seen the lack of teeth of the enforcement bureau has had recently, so hopefully it will go this route. Now the NAL can be disputed to have the amount reduced based on factors, such as failure to pay, first time offense, etc.FCC will probably let him off with a warning or maybe assess a civil fine which he probably will never pay.
He would usually have to persist for the FCC to refer to DOJ for 47 USC 301 criminal violation to have the FBI or Marshalls seize the equipment and haul him off to jail.
That is why I wonder what action the local authorities took once the FCC identified the subject. The FCC investigation findings should have been sufficient evidence for a warrant for arrest, search and seizure under NY Penal Law. Local authorities usually can't prosecute simple unlicensed operation like an FM Broadcaster. But in this case the radio was an "instrumentality" to the NY crime of Obstructing Governmental Administration and the broadcast threats were Aggravated Harassment. No different than if the obstruction and harassment was done by phone and the calls were traced to the subject as is the case with false, harassing and/or threatening 911 calls.He needs to be place in the correctional facility then he can run his mouth all he wants
