It would be very difficult to tell. Up to 5 watts is legal on FRS channels 1-7, if you have a GMRS license.

I can relate.. Me and a handful of other guys all spent our life's savings on repeaters for those 49Mhz toy radios you can get at toys R us.. It really upsets me when I people using these radios with such blatant disregard!.. Often times by children!.. I swear, who do these people think they are why buy a radio off the shelf, and just ASSUME they can open the package and begin using it? Don't these people ever visit radio reference.com and know all of the arbitrary and obscure FCC laws??!? I know that when I buy a product I spend at least an hour making sure it's legal to turn it on first..

As of late though things have improved somewhat with the introduction of the FRS GMRS combo radios, which have quickly replaced the 49Mhz toy radios as non radio savvy types' and childrens radio of choice..

I think though with all of this frustration, I should stop pretending to be a ham with silly little radios, and just bite the bullet and take the test...

Thats just me though..

There are alternatives to bubble packs and yes you can get MURS radios. As I pointed out in an earlier post, check out the advertisers at Popuplar Wireless. gmrs in canada has no such licence :D dont know about the USA..is it still 2 watts for both countries? i forget

§ 95.135 Maximum authorized transmitting power.
(a) No station may transmit with more than 50 watts output power.
(b) [Reserved]
(c) A small control station at a point north of Line A or east of Line C must transmit with no more than 5 watts ERP.
(d) A fixed station must transmit with no more than 15 watts output power.
(e) A small base station must transmit with no more than 5 watts ERP.
If by "IMBE/Analog" you mean you are using digital voice, that is also not permited:
§ 95.631 Emission types.
(a) A GMRS transmitter must transmit only emission types A1D, F1D, G1D, H1D, J1D, R1D, A3E, F3E, G3E, H3E, J3E or R3E. A non-voice emission is limited to selective calling or toneoperated squelch tones to establish or continue voice communications.
See § 95.181 (g) and (h).

Yep, IMBE/APCO-25/P25, whatever terminology you prefer, yes. I eventually took it down and it's on 440 ham now because there just wan't too many GMRS users in my area. (only 5 or 6 used IMBE) - about 20 or so now on 70cm. I'd like to have it on a band where it actually gets used and promotes digital usage.
