The pictures in the article show a Uniden type scanner...I have a baofeng uv5r radio, it looks nothing like the picture...Many railfans are using boafengs or similar. The temptation to TX is too great for some. Its all fun until the FCC or rail operator shows up at your door. The penalties are pretty harsh from the rail companies especially if they go after you for interfering with operations. Yes just the time it took for the rail employee to say "Who is this?' is enough to nail you.
Bottom line do like the rest of the responsible community does. Monitor to your hearts content but do not think about TXing no matter how good your intentions are. Know the emergency numbers for the lines your on. The dispatcher can call the train and be believed immediately in any situation.

I agree, but the way the article was written...plus the picture...leaves me "scratching" my head so to speak...unless Uniden has started to make the BC125AT with TX capabilities...Hopefully it means only that he used the context of something he monitored to strike up a conversation with a worker.
Last time I checked and read the article he goes to the DEPOT and that is not tresspassing....Last time I checked trespassing on railroad property is a crime.
