first off I know the limitations of certain scanners and I AM NOT ASKING FOR A DECODE. However will there ever be a scanner that just skips over signals it can't decode, like P25 Phase II or DMR? Just not even stop to hear the data channel or whatever the signal it can't decode?? Just skip right over it???

Bearcat Uniden 996p2. Mine open ups on unencrypted transmissions on encrypted channels. Some of the handhelds on my police, sheriff frequencies are not encrypted. If there is no unencrypted signals it does not stop. Firmware must be up to date.

To sum extent, to know it cannot decode them, it would have to recognize them, which means decode them.

On the newer Whistlers you can tell it to search for certain signal types such as NXDN, DMR, P25, but you can't exclude unreadable signals. Doubt you will ever see a new scanner without Phase II or DMR at least as an option.

There'd have to be some sort of algorithm telling the scanner "hey, this is a signal I don't understand" versus encountering analog voice traffic with a scratchy signal a listener may be trying to DX. Might be more complicated than it seems. This is what the Avoid key is for on the Uniden x36HPs and SDSx00's. Press it twice for a permanent avoid, problem solved. Also unwanted frequencies can easily be excluded when programming FLs.
