kentucky and scanners

if i carry my scanner over into kentucky from tennessee can they take it or is there any law about having a scanner in the vehicle with you in kentucky

YES they can (and some cops WILL) take it, unless you hold a valid ham license. I will look for the KRS and forward it to you as soon as I get a chance.

Wouldn't the law of the state the car is registered to from a legal state overrule these other state laws. I use mine for a cb radio while driving to Florida every year and haven't had a problem yet.

Nope... where you are is where you are and when in Kentucky you must abide by the laws of the Commonwealth...

Get a ham ticket before your trip.... it is too easy not to have at least a technician's ticket any more.

Go thru the practice tests until you can answer almost all of the questions and then go take the real thing.... for all of you old-time hams out there, I acknowledge your consternation at me and those of my ilk for taking the "easy" way to a ticket, but all I need is a Technician's ticket to do the Skywarn thing, so that is all I really want.....

there IS a loophole. if your scanner can recieve NWS weather broadcasts, you ARE exempt. and what scanner dont do that?

the KRS should state this. I have a printed copy of it in each of my trucks.

I got pulled over for speeding just the other day...the KSP trooper that pulled me over was suspicious of me at first with 3 radios in the car and said "You know those are illegial" but then when I showed him a copy of the Kentucky General Statute along with my Ham License he became more friendly and even said "I guess you can teach an old dog new tricks" and even asked me some radio/frequency related questions....he was even gracious enough to let me off with a warning...so just be polite and always carry a copy of the Kentucky laws with ya and things should be ok :cool:

You are leaving out an important part of your "loophole", in that subpart 6 states that an order signed by the secretary of the Commonweath of Kentucky Finance and Administration Cabinet is required for your unit to be exempt for NOAA use.

I know KRS432.570 fairly well due to the requirements of my employment, and IMHO the best way to "stay legal" is to have a reciever only and a "ham" license.

LOL. thanks. sorry, as you can see sometimes i only read as much as nessecary... but i'm still a ham, so i'm still fly. LOL

Odds are that if you don't do anything to attract attention to yourself, you will be fine.

On the other hand, if you have eight or nine antennas on your car and tend to drive it like you are qualifying at Daytona, look for trouble.

A couple of suggestions, more or less combining all of the above.

1. Don't attract police attention, such as speeding. If you get stopped, then you'll have to prove yourself correct for having a scanner.

2. Print out the statute (KRS432.570) and staple a copy of your Amateur license with it, so if #1 doesn't work out so good. Be nice to the police, bad attitudes have generated a lot of tickets.
