Local Sheriff's office is DMRE if unencrypted can I listen with the right scanner?

Title Sums it up,

I have a HomePatrol 2 and looking to upgrade to something with DMR for the very reason that shortly after local PD hopped on statewide P25 system (My HomePatrol 2 picks up well btw) The Sheriff in his infinite wisdom went with DMR radios.

I assume they are unencrypted, and I could reach out to the SO if I really needed to, but the main question is:

If I buy a DMR capable radio (i.e. SDS-100 w/ DMR upgrade) and the Sheriff's office is unencrypted, can I pick the radio traffic up without issues?
