What I DID ask was: Do they still use 37.9mhz. An expired piece of paper will not stop a radio from working.

Nope, they moved a long time ago to UHF DMR. I understand what you are saying about licenses. But no County Highway Department is going to maintain their old low band system in each piece of equipment after they moved to UHF DMR at least 10 years ago.
