Oklahoma City (AP) - Thursday July 05, 2007: Authorities say a man being questioned about reports of vandalism in the neighborhood was fatally shot after an altercation with two officers and several bystsanders.

Sergeant Paco Balderrama says officers had responded to a vandalism complaint before 2 this afternoon at the MacArthur Apartments on Northwest 10th Street.

Balderrama says when officers made contact with the man, they detained him after he gave what officers called false information.

The officers placed him in a police cruiser and were trying to handcuff him when he ran away.

Balderrama says it's believed that five to eight individuals -- family members or friends of the suspect -- got into the fight. That's when one of the officers unholstered his weapon and fired, killing him at the scene.

The identities of the man and the two police officers involved weren't immediately released.

Some of the individuals were taken into custody.

Yep, what a bunch of morons.. I think I hear Rev. Al and Rev. Jesse coming to incite I mean heal the "community".. LOL..

Statement Issued On Officer-Involved Shooting

*** Yesterday at 1:05 pm officers responded to a Vandadalism/Disturbance involving neighbors an 5001 NW 10th. The call stated that a suspect, who had kicked in a door three days prior, was currently at the complex.

Upon arrival officers made contact with the suspect who was later identified as 32-year-old James Lee Ware (Black/Male, 5-16-74). Ware was placed under "investigative detention" after he was pointed out by a witness as being the one who was seen running away from a house, after a piece of asphalt was thrown through a window. Officers then inquired about Ware's identity, who gave police fictitious information. Officers decided to transport Ware downtown for fingerprinting and positive identification. When officers opened the back door to handcuff Ware, he forced his way out with his legs and ran away from officers. Sgt. Paul Galyon caught up the suspect and tried to detain him. Ware struggled and fought with Sgt Galyon when the two fell to the ground with Sgt. Galyon on his back and Ware on top of him. Sgt. Galyon had his hands pinned under the suspect.

Sgt. Jeffrey Pope tried to assist Sgt. Galyon by applying O.C. Spray in Ware's face. The O.C. Spray also got in Sgt. Galyon's eyes which quickly took away Sgt. Galyon's ability to see. During the struggle a crowd of about 10-15 people, believed to be Ware's friends and family members, attacked the two officers. As Sgt. Pope attempted to push the crowd back, Sgt. Galyon felt Ware violently tugging at his duty weapon. Sgt. Galyon believed the suspect was trying to take his weapon and use it against the officers. Sgt. Galyon yelled at Sgt. Pope that the suspect had his gun. At that time Sgt. Pope un-holstered his own weapon and shot Ware.

After the shooting took place the crowd ran away from the scene in several directions and the two officers heard 2-3 additional shots fired within the complex. Backup units responded to try to locate the fleeing individuals and secure the scene. EMSA was called to render aid to Ware who was later pronounced deceased at the scene. Detectives from several other units responded to assist in interviewing witnesses and potentially involved parties. Several people were transported to Police Headquarters for interviews. No additional arrests have been made.

It is now known that Ware had two outstanding Felony Oklahoma County Warrants. One (CF06005657) for Failure to Appear in a Attempted Aggravated Eluding a Police Officer, Possession of an Offensive Weapon while Committing a Felony, Possession of CDS with Intent to Distribute and Possession of Drug Paraphernalia case. The Second (CF03006197) for a Violation of Suspended Sentence in a Trafficking Cocaine, and Possession of CDS case. It is believed that the warrants are the reason Ware tried to escape officers and resisted arrest.

34-year-old Sgt. Paul Galyon (13-year veteran) is on injury-leave from injuries sustained in the incident. 31-year-old Sgt. Jeffrey Pope (8 1/2-year veteran) has been placed on routine administrative leave with pay pending a full investigation on the incident.
