If you are confused there in the UK, imagine a Yank trying drive cross country and knowing if their scanner is legal or not.

Yes the UK is Nationaly clear cut and the same (at the moment) on lawful radio reception/use. However devolved governments (Wales, Scotland, Northern Ireland) could easily pass their own laws on such matters.

I guess with US having so many states it must be even more confusing especially if one type of installation is OK (home/base) and another (mobile) may not be.

Privacy for a citizens personal information is understandable, privacy for a tactical operation, can save lives, however the day all police communications becomes encrypted is the day we'll essentially have our own version of "The Secret Police". In today's political climate, engendering fear or mistrust is something I believe should be avoided.
