Chasing a Police Scanner: Police Calls in New York City

A couple of discussion questions:

1. May I carry on my person (such as in my pocket) a portable scanner, and listen to it, if I'm a passenger in a cab?

2. May I carry on my person, and listen to, a portable scanner in my private vehicle?

Neither vehicle has been "equipped".

3. Does anything change if the scanner goes from my pocket to the seat beside me?

"A person, not a police officer or peace officer, acting pursuant to his special duties, who equips a motor vehicle with a radio receiving set......"
If I carry a Pro-106, the car isn't equipped; I am. If the law was written in a way that didn't foresee the eventuality of a hand-held, police band-capable radio, then there's your loophole.

if you have a desktop like the pro-163 would it count if it was in the hotel vroom on a desk and if it was on when the housekeeping lady came in what would she do

here in the city of Independence Mo. if you have a scanner in your car or on your person your braking the law. according to a Sargent that tried to take mine.
