Since MD-380 is acceptable for commercial use, you can use encryption using frequencies outside 420-450 Mhz, with the right FCC license.

Yes. While encryption is not legal in amateur radio (except for telecommand of satellites), it is legal for use under Part 90. Encryption and Interoperability takes a lot of work and upkeep. Simply turning encryption on because it is there isn't always a good idea. Knowing when and when not to use it takes a good understanding of how everything is going to work.
