While you may be able to "argue" with RadioShack & get it fixed, There is presedent in many categories, including retail electronics, that your warranty is valid only if bought from an Authorized Dealer. Icom, Yeasu, Kenwood Alinco have this policy.
You really shouldn't have to argue. However.... If Grove or whomever is an Authorized reseller then that ends the from a unknown source part of that. If you bought it on Ebay, second or third hand and the unit isn't abused and any defects or inoperability is not due to carelessness etc... It would be covered under the manufacturer's warranty. Since the item we are discussing isn't over 1 year old, no matter where you got it, it is under warranty without question. Now after September then I can see were what you are saying to be true and you will have to provide some sort of proof of purchase.
What if a Radio Shack dealer had a scanner laying around that was broken, "zapped" or whatever, & sold it to me "As is" final sale for 10 bucks.
Most products sold as-is have a mark indicating such. And if the product is sold damaged, it more than likely would NOT be covered under warranty, even if it is 3 days old.
Can I throw away the receipt, get one from my buddy at "Joe's" car stereo & tell RS to fix it for free??
Fixed for free? Probably not if it is damaged. But we are talking about a firmware upgrade, a manufacturing defect, that is indeed covered for 1 full year from the date of purchase.
Grove & Scann Unlimtd simply buy RS scanners in bulk from a franchise store at a discount, & resell them.
It is still a Radio Shack scanner purchased through authorized channels, even if it is buying from a franchise in bulk at a discount. If Radio Shack didn't approve of this activity, beleive me, they would shut it down, no questions.
Basically, any store would/should provide you with a no-cost upgrade path because providing customer service is what we are supposed to do. If you come to a store get your scanner upgraded or mfg defect repaired then you will be happy and will most likley consider returning to that store for any future purchases. It's all about winning and keeping customers. If a store insists on a receipt or some form of proof of purchase they are following the company guidlines however any store that wants your business will realize that the scanner is less than 1 year old and this is a manufacturing issue and thinking customers first is a company motto. Failing to take care of you would be bad for business.
Sure there may be a store or two that won't take care of you. Then drive the other 10 minutes to get to the next Radio Shack that will most likely take care of you.
Again if ANYONE comes to my store for an upgrade, they will be taken care of, no questions asked.
