Right now NC has both P25 phase 1 and 2 radios. From a scanner monitors perspective, that's what you are seeing. Nothing more really. When the powers to be resolve any issues, it will all be phase 2.

VIPER sites have been 100 percent upgraded to phase 2, this was completely done as of July of last year. However radios using phase 1 are still using the network along with phase 2 radios. I am watching the control channel of my closest VIPER site as I type this and seeing phase 1 radio transmissions passing through.

Every talkgroup should be set to dynamic dual mode unless it is new as of 7/1/25 (TDMA only), an agency has requested their channels to be locked to TDMA only, or a programming error has temporarily forced talkgroups to be forced back to FDMA until the bandplan issues are updated. If a dynamic talkgroup has only TDMA capable radios on it, it will switch to Phase II. If a FDMA only radio affiliates, it knocks the talkgroup back down to Phase I. I should hope that more and more talkgroups will start remaining TDMA as time goes on and radios are updated.
