Does section 133A also apply to ham radio?

im not lawyer - but from what i read, Yes it would.

The only way it wouldnt would be if there was some clause in the HAM RADIO general rules that state HAM transmitting it intended for ALL recipients that can listen.

Spoke to RSM, they say.

Section 133A(1) applies to all individuals ("every person"), except those permitted under subsection (2). Subsection (2) does not apply to Amateur Radio Operators.
