Yes it does get enforced

I know of a couple fellow firefighters who had their equipment confiscated, but it has been years ago.

One of the firefighters had his equipment returned after appearing in court, but I think he got real lucky.

I know an officer that hates people, yes he takes them. Of course, he is one of those "Write his own grandma a ticket guys."!! Wait, come to think of it, I know a lot of those guys! Do what the signs say, "DRIVE SMART KENTUCKY"

By the way, I'll check with some of my connections of higher knowledge to find out if it is illegal to have the scanner in a rig (SEMI or COMMERCIAL vehicle)

Get your ham license and that will no longer be a problem.

I iam a ham kf4dss

In short, it is my understanding that it is illegal to have a scanner in your car in Kentucky UNLESS you fall into one of the following categories:

1. You are an active member of the news media
2. You hold a valid Amateur (Ham) Radio License
3. You work for a towing agency
4. You are an active Law Enforcement or Fire Employee

As a ham radio operator, I carry a copy of a letter which was distributed by the KY State Police to ham radio operators several years ago to show to law enforcement personnel in the event they want to cite me for having a scanner in my car.

Years ago, I heard of instances where scanners were confiscated and even destroyed, on the spot, by law enforcement officials. And, of course, like most states, if you are involved in criminal activity in KY while using a scanner, you can expect to have the book thrown at you.
ME being a ham holding a f.c.c lic here what happen two weeks ago in anderson c.o ky i went threw a road block and the state trooper looked at my driver lic. Then he sees my dual band kenwood ham radio that dose not trasmit out of band he ask me to trun it on and heres him self on there on 154.665 wich is car to car , he demanded i take these out or i take the radio i show him my hamm l.i.c. and a krs law .Still he demand it but said go on but i dont wont to see this radio in you van aging . So in onw week me and mmy family go to wallmart why i was parked in a parking place wating on my girlfriend with my kids in the van here he comes with two other anderson c.o. units . He walks up and said i thought you was takeing you radio out ,once aging i showed him krs, ham lic he still told me this time to take those frequncey out . I thin contact ksp head quters law deperment in frankfort ky and they told me i can run this radio with this frequncey in there so i dont what to do i donmt wont to be breaking the law , that i know that iamm not but this state trooper keeps on me like glue only about this radio . any info on this woould be nice thanks kf4dss@gmail.com

Sounds like this might be getting to be a personal issue. Sometimes people have difficulty with being told that they are mistaken about something or the manner in which they were told. Then it goes from being an academic issue to a personal thing with high levels of testoserone.

I suppose you could send in a letter of complaint on him, but I imagine in the long haul all you'll do is throw gas on the fire.

I've always looked at winning wars and not necessarily winning battles. My inclination would be to either remove the radio or give all appearances that you have done so. Then give the trooper some time to move on to other conquests.

Very strict law...the way I interpret it, is that if I buy a scanner from any Radio Shack (or other store) in Ky, I better hurry home to get it in my house :)

A sign that the law hasn't kept up with technology...anyone with a smart phone can download a free or .99 app that will allow them to listen to scanner feeds, or thru RR using the browser. I am not against good laws, but this one borders on a abuse of government powers. All of the handheld/portable scanners sold instantly turn their owners into lawbreakers.

Been like that for as long as I can remember.
But If You have just bought one as long as it's not powered your okay till you get home.
It's not that bad.
