Security Guards arresting (or detaining) people on warrants?

Seriously though, what difference is it of yours what is done when these things aren't being used for "city/county purposes"? Should they be around collecting dust when an officer isn't on duty?

Not to assume the prior posters thoughts, but if the equipment was city/county/public whatever provided, then where do you draw the line? Do public works employees get to moonlight with heavy equipment?

It's just an iffy situation to be thought through.

The security guard at that apartment may have daylighted as bounty hunter. Bail Enforcement agents operate under the wild west rules. There's no such thing as search warrants, Miranda rights or anything like that. Why? Well all that stuff was done back at the original arrest. The warrants and rights were done by the police at the onset of the initial arrest. What you have is a someone who has arrest warrants and has skipped bail and failed to show at appearances as promised. The problem with holding someone on these issues is making a mistake. It can be costly and illegal to hold someone falsely. Then there are times when the person you are hired to find is in a small county jail. That happened with Carl, if you knew him. He was so darned lucky. Here he had this $3000 jumper (that's what Carl was to get) sitting in a jail and all he had to do was serve papers to the sheriff. Of course he also had to give an honorarium to the LEO who called to let him know where the guy was sitting. Its not a world you want to enter unless you are ready to find society's worst of the worst.

My advice is grow a mohawk, loose the shirt, and wear fake Native American jewlery, if it doesn't scare the bad guy into giving up your fire extinguisher size OC spray can in the taci-cool drop holster will ;)

Read up on your oklahoma statutes like title 22

According to the state of oklahoma statutes title 22 chapter 3 section 202 it states:::

A private person may arrest another:
1. For a public offense committed or attempted in his presence.

2. When the person arrested has committed a felony although not in his presence.

3. When a felony has been in fact committed, and he has reasonable cause for believing the person
arrested to have committed it.

In todays computer age, you can go to most city or county sites and get a search page for warrants.
I personally have made many arrests for FELONY warrants. I am an armed security officer, I have never had any problems, because of the above statute. An arrest for a misdemeanor would have different criteria, it must have been committed in the presence of the arresting person.

In Kansas City, Missouri private security companies can subscribe to the REGIS database. Person, address and vehicle tags/VINs can be ran with limited access for warrants and owner history. A couple security companies would routinely detain people for minor warrants. Sounds like the laws down there sound different, though, KCMO private security companies have their officers commissioned through the Police Dept.

Speaking on the Mulitifamily side of things.

I got my start at what was the largest Apt. community in the midwest.(previously, one of the worst) We had some of the largest drug, gun, and OC busts in state history. It was so bad that we couldn't hire security, and cops would roll through (about 20acres) every 20-30mins.

The cops would regularly supply us with folders, yes folders, of wanted sheets, so we could give them a heads up, and keep ourselves safe. I'm guessing they were told who to look for by local officers, and when they had a reason to hold them they did.

I have to say, it was the most exciting job I ever had! Nothing like trying to rent an Apt. while there is a armed standoff 50' away. (I got the App. BTW) Or being called out to "assist" in a raid. (The doors, and frames, were solid steel so they needed keys,or us to pretend we were there to fix something)

Oh the stories I could share.....

I think it's funny that this topic comes up again today, since the last post on this was in 2009?
Security officers in illinois have the authority to observe and report, that's it.
