This is an interesting reply that somebody recieved from IC:

Yahoo! Groups

Re: [Scanont] Change in Industry Canada Digital Scanner Licence ?

This is what I got from IC:

In response to your inquiry, a radio licence must be obtained prior to
possession and use of a scanner receiver. Each application is reviewed
individually upon receipt. However we have decided based on RSS-135
section 1.1 (e)
http://www.ic.gc.ca/epic/site/smt-gst.nsf/vwapj/rss135.pdf/$FILE/rss135.pdf
that equipment intended for use by amateur radio operators, and not
capable of scanning bands other than bands allocated for the amateur radio
service, will not require a licence, since your amateur certificate will
suffice. Any other desired use would require completion and submission of
an application. For example, should you intend to operate the scanner to
receive signals within the land-mobile bands, you will need to complete
the appropriate application for a mobile receiver licence, and the
applicable fee will be charged should a licence be issued.

I hope that helps to answer your questions.

An official response will of course restate protocol and procedures that must be adhered to. I wouldn't expect a Manager to say no less.

I just wonder why there is a compusion to put this issue on IC's radar?

Do people really want restricted sales and applicable fees remitted to the governmemnt.?

The radio stores are just covering thier a$$ (CYA) ,
im sure the stores know its BS as well.

Better to get buyers to fill out a form, then get hassled by industry canada.

well, lets just say i was surprised when they told me that i had to fill it out.i also mentioned that if i bought it mail order i wouldnt have to fill it out.the counterperson told me that industry canada does makes visits, and checks for proof of sales of digital scanners, and they apparently look over the "licenses" and go on their merry way.

i just picked up a psr500c from durham radio last saturday and they said that unless i didnt fill out the license, they wouldnt sell me the scanner.i told them that it was a crock of ####,and the license consisted of a photocopied sheet of paper that needed your name, addy and get this...your drivers license.thats it! nothing with "Industry Canada" on it.absolute joke.......

You where asked to fill out a form that stated you understood the rules and regulation from Industry Canada - this is not a license! Copies of there regulations are available at the store or on line at Industry Canada.

Digital License at Durham Radio

Durham Radio has NEVER asked anyone to make out an application for a digital license, they have never even seen a license or the application for one, but they do ask you to sign a waiver stating you understand the rules and regulation from Industry Canada and they just keep it on file in case the IC ever gets organized enough too start monitoring the sales of these items which may never happen. I don't see what everyone is all worked up about, this has been going on since the scanners where first released in Canada. All it does is keep them above board with the IC and lets the customers know about the IC's possible intentions.

Very strange - all the ones that I have seen from Durham Radio make reference to the Industry Canada RSS135 and the IPC2104 regulations - maybe you should stop by and read what you signed.

If Durham Radio is doing a waiver in that regard I have no problem with that.

Is this License BS still floating around??:(

I ordered 2 scanners from Lectron in Ontario and never heard a word about any type of license at all. Why would you buy from Durham with all that hassle. Walk out on the guy and take your business somewhere else.

Edit: Sorry if I am ranting a bit here as I had made the same comment on page one before but it just gets my gander up this So called License topic.

The Truth

In canada if you wish to own a digital scanner you are required by industry canada to hold a land mobile radio lisence. The reason being ... these radios recieve digital, private and miltray frequencies.

Types accepted are:
Ham/Amature radio certificate (any class)
Land Mobile License
Restricted Radio Operators license (any class)

Basically industry canada is just want to ensure security is being maintained in regards to the "digital" systems. in the US scanners are pritty much banded in most of the states, and limited in other or completely legal in a few. Were like a secret sociaty ;P ... Ive attached the link to the Industry site regarding the classing and licensing of these radios. My license cost my 75$ and took 5 mins to complete thae exam, and i assume 95% of the users here have their basic ham atleast.

Scanners are not pretty much "banded" in most US States contrary what you said. Limited? Yeah in some states but its mostly with mobile operation.

Anyways, your URL is just for the manufacturer. It does mention an "exam" of any kind nor the cost of it. Nor does it mention that you need a land mobile radio license in any of those classes.

If you really did take a exam and paid $75 for it from IC, I want to see some paperwork on it.

its not for manufactures only, does take some reading. as for the classes i was only giving examples, i have a restricted radio operators license class A(which i took in conjunction with my MNR fire fighting course) .. For radio classes follow this link to secion 1.2 .. explains which licenses are equal to a ham license which is required to operate a restricted digital frequency scanner in canada.

Spectrum Management and Telecommunications - RIC-3 - Information on the Amateur Radio Service

Bellow is the link to the license class explinations and testing requirements. sorry theres no set licensing cost, its as per the tester. And quick correction my radio license was 95$ sorry

Okay. I still don't see a specific mention or any other correlation between the Digital Scanner license and having any form of a land mobile, amateur radio, or other types of licenses in any of those links from IC.

I think someone is lying to you.
