the only way to be fully compliant is to not broadcast the information over an LMR radio at all.
Any public safety agency must abide by the rules for handling CJI/PII if they are connected to CLETS. That includes everyone/anyone that has access to the information, loads encryption keys, has access to the physical dispatch equipment, spaces, terminals, servers, etc. If an agency is not doing that, they can get their accreditation pulled. We go through this once a year. I have to do the training or I get locked out. The agency I work with is very careful about this, as are most.
No one should have access to a radio that is loaded with encryption keys if they haven't been background checked and have completed the CADOJ/FBI training. If a radio is lost/stolen, it should be reported and encryption keys changed immediately.
Officers should be taking steps to make sure radio volume is at a level that the general public can't hear, and why many use earpieces.
And the FBI/DOJ rules do allow transmitting PII/CJI over the radio if it is properly encrypted. That would be fully compliant.
