Ubsurd Radio Law?

"No matter what frequency range the radio is capable of it has the ability/potential to transmit on gov't/police/fire/EMS, and is therefore considered a terrorist act to possess one."

Well, I guess I am going to spend the rest of my natural life in a federal prison because i posses a LOT of radio gear that can and will operate on Fire, EMS and Police frequencies. Both of my Bendix/King radios will do it, all of my Motorola gear can do it, a few of my various peices of amateur gear can do it. Basically with the exception of my Azden PCS 3000 everything I have in the way of tranceivers is capable of operating on frequencies that are typically assigned to public safety agencies.

Like I said, it goes to show, how even some educated in how to use radio gear, can still be scared into believing its "illegal" to have. He went on the email to state how he was ALMOST arrested for having it. He also said, that the police were gonna let HIM destroy the radio... Last I checked, if something is illegal like that, they would confiscate it as contraband no?

Its too bad I don't know what he did with his radio ;), I could use another...

Was this a "Friend" or just an email contact?

Did the email come to you, or was it just posted to the batlabs forum?

Sounds kind of gullible.

So why don't you ask him where he "found" this law?

My 2 hobbies are the two things cops seem most ignorant in the laws regarding, and most eager to spew BS about as if they know...guns and radios.

It is bad enough with hams getting harrased in many states for having legitimate ham gear, and now someone is spouting this garbage? I guess anyone in that precinct with any type of two way gear other than bubble pack FRS units is a criminal, because all of your business band stuff can be used in some sort of a public safety system somewhere...

Yeah, if this really happened those cops are full of it and your "friend" needs to pursue this further, to the point of filing harrasment charges. Letting them get by with such BS, lieing about the law and telling him to destroy something legally owned just encourages such behavior.

I have had several instances of cops who didn't know what the hell they were talking about try to lecture me on radio laws. Even more in regard to gun laws.....

I still go with BS.

Here is my logic.

1) First he looked for a law that does not exist.
2) He proposes he found it with excruciating detail. (yet provides no link or reference)
3) He goes to the police station to confirm it.
4) He sells his radio because of the law. (A bit extreme, as first reaction)
and only then he contacts his "Radio Friend"??

Sorry, just does not pass my smell test.

it is considered a TERRORIST ACT to POSSESS an MTS2000 radio, and the MINIMUM penalty is 50 years to life in federal prison for mere possession of the radio without authorization.

I also check, and even if you are volunteer fire, or even a cop, if the radio is not issued to you by your department, YOU MAY NOT HAVE IT.

I got rid of my radio since

I asked several cops at the 6th Precinct, and they confirmed this law, and the penalties to be correct!

I'm just warning you ahead of time since I don't want to see you get arrested.

I once had an Oklahoma Highway Patrolman tell me I needed to change the high-beam indicator dash light in my 1970 Chevy pickup back to blue (it was red). He said the state statute mandated it MUST be blue. I just laughed at him, sine it left the factory like that 30+ years ago. :lol: Seems very similar to this situation.

Every now and then you'll run into a police officer that thinks he knows it all, and they don't. Sorry if that wasn't clear enough :roll:

Yes, but the (supposed) fact he asked a cop, is about as believable as the rest of his statement.

I can see a officer being mistaken about a point like allowable colors on indicator lights that have changed over the years.
I can also believe a cop "showing off" how well he knows the law and how much power he has.

But comparing that to what is said to have happened is like comparing getting stopped for a broken tail light to saying the cops set up spike strips at the base of your driveway the morning your insurance expired, just to catch you!
