Upcoming changes to FSS 843.16 (Scanner Law)

I am planning on visting Miami in a few weeks and will be arriving via MIA. I took my scanner with me last time without any problems. Under the new law, is the only law I would risk breaking is having my scanner in the suitcase in the trunk of the taxi? I don't plan on using my scanner anywhere exepct in my hotel room.

I always check all my luggage. I don't like carrying things on the plane.

I am planning on taking it with me again and pleading ignorance and begging for mercy if anyone ever questions me about it.
