and yes, police officers in michigan exspecially those of County Sheriffs do go on power trips quite often...........trust me, I've dealt with em....

Boats are indeed vehicles, so the statute does apply. The part that eats me about the story is that the LEO told them to turn it off an put it away, even after the permit was shown. BUZZZZZ!!! WRONG!!!

We had a conversation about that very thing on the way back to the cabin. That's why we thought the sheriff was on his power trip (do I dare use that word again) of the day or something. I have a permit, I had a scanner, though it wasn't on at the time and was clipped to my belt under my shirt. The officer never even saw my scanner. I did show him my permit. My friend's scanner was on and he was the operator and owner of the boat. So... even though we didn't want to rationalize it he didn't have a permit to use a scanner on his boat. If I had been the person at the helm would it have been ok??? Not sure.

According to the law there is nothing that says that operator of the vehicle has to be the holder of the permit. So mine should have covered it. Oh well.

Not trying to make a personal attack on you Russel, just to make a point of lets all use our head a little more in regards to mobile scanning.

I meant it when I said the above, but I guess I did come on a little strong, & for that I apologize.

My whole point is so many people are taking a huge chance at having their $500 digital scanners taken away from them due to the misconception that they have a permit or ham license so they are safe.

That is why I always stress to people to use their common sense a little more and be careful with their monitoring habits.
