Municipality capping tower height?

Hi! My municipality is capping the height of any ham radio tower at 30'. I thought all ham radio rules were set by the Industry Canada, not at the municipal level.

Can they do that?

I think it depends on your neighbourhood. If you are in an area with heritage designation, it may degrade the landscape, or so they say. I'm using Montreal as an example. I'm sure Ville de Quebec would be stricter.

Browsing the web, I think I saw that it can't be more than 6m over the rooftop.

Well, I have searched the web as well, but couldn't find any definitive / clear ruling.

I am no where near a heritage neighborhood (old town Québec City). I am in a residential neighborhood just outside of Québec proper, in a town called Boischatel. I've inquired with the urbain planner and they sent me documentation, which reads in part:
> 1° une antenne accessoire installée au sol doit respecter les dispositions suivantes: la hauteur ne doit pas excéder 5 mètres dans le cas d’une antenne parabolique installée au sol, et 10 mètres pour les autres types d’antenne, calculée à partir du sol ; ce dernier type d’antenne ne doit pas être soutenu par des haubans ;

Which translates roughly to: non-parabolic antennas are limited to 10m in height (30 ft) and cannot use guylines, as mesured from ground level.

30 ft seems a bit low to me. I live in a 2 story house (house is about 4' above ground, plus 2 stories and floor 16' + 1' and roof: +- 12' at the apex for total of about 33'). The tower wouldn't even clear the house.

No, they cannot, check the ruling Rogers Communications Inc. c. Ville de Chateauguay from the supreme cour (2016-06-16),
Only the federal gov can rule on antennes structures, cities have rules that predate that judgement and you have to remind them that they don’t have authority on antennes structures….

In the US a city or county can regulate tower height and my city requires a permit for anything over 35ft. I can probably get a permit for a 60ft tower but would not know until I start the permit process. A city next door to me requires a permit for any tower and the process requires contacting every neighbor within 500ft for them to comment on the proposed tower. If the tower will impact their view in certain directions the tower permit may not be issued. Every city and county is different.

Hi,

Contact your provincial ham radio federation : RAQI.
They have the knowledge to support you, as this situation is not unique or specific to your place 😉

Back when I was looking at putting up a tower, someone told me I could go up to 48 feet without involving the municipality in any way. I consulted with RAC's lawyer at that time and he pretty much said the same thing. Take a look here for a little more info:


After I pointed out to our municipality that they had no say in anything under 48 feet, they relented but wanted me to get a building permit and an Engineer's stamped blueprint for the base. They said they couldn't regulate the tower but they could regulate the base.
